- Badan Penyelenggara Jaminan Sosial (BPJS) is an institution which established to organize social protection programs in Indonesia. BPJS consists of two parts namely BPJS kesehatan and BPJS ketenagakerjaan. BPJS has the impact for pharmaceutical companies in Indonesia related to the procurement of goods and services. The review of this research are to determine the impact of BPJS Kesehatan against pharmaceutical industry in Indonesia as well as to determine the mechanism of procurement of goods and services by government in BPJS Kesehatan. The used data in this research are primary and secondary data, examine the legal principles, kaedah hukum, and systematic of law by researching bahan pustaka as a secondary data. From the resulting of this research, the authors is concluded that BPJS Kesehatan has impact against pharmaceutical companies in Indonesia namely on the Procurement of Goods and Services.The formely cooperation is only by a bilateral agreement between the pharmaceutical company and PT Askes (Askes). In the procurement of goods and services, ULP has an important role as the executor of the beginning of the tender held up to the announcement of the winning bidder. In the implementation LPSE be the providers of electronic procurement system and operate their own e-procurement system developed by SPSE named Audited. LPSE is a unit which has set up by the Ministry of Health of the Republic of Indonesia. LPSE is a facilitator who did not participate in the procurement process.
