- The objective of this research is to analyze the agreement between klitikan traders and Office Of Market Management Of Bantul Regency, whether it has been implemented as lease agreement or as borrow and use agreement, and to analyze settlement of default on implementation of agreement on performance of the use of Klitikan Niten market stall. The secondary data was gained through library research, which is legal material study. The primary data was gained through empirical research, which is via interview. This research conducted in Klitikan Niten market, Glondong Hamlets, Tirtonirmolo Village, Kasihan Sub District, Bantul Regency. The result indicated that the type of agreement between klitikan merchant and Office of Market Management of Bantul Regency was borrow and use agreement. The settlement of default on implementation of agreement of the use of Klitikan Niten market stall carried out by means of persuasive method.
