- The aim of this research is to discover the practice of land tenure in sub district of Gunung Bintang Awai, to discover the practice of land sale and purchase by using the title of Statement Letter of Land Physical Occupation, to discover the recognition of Statement Letter of Land Physical Occupation in the implementation of land registration in Land Regional Office of South Barito subdistrict, to discover the legal consequences of land sale and purchase by using the title of Statement Letter of Land Physical Occupation. This research uses juridical empirical method by reviewing provisions of applicable laws, and in society. Study subjects consisted of respondents is the sellers as well as buyers who have committed transaction and the resource person is the parties who understand the research problem. The method used for sampling is purposive sampling The research�s analysis being used is descriptive analysis the implication. The research result discovered that First, the land occupation that has no certificate in Gunung Bintang Awai sub district is proven by the Statement Letter of Land Physical Occupation that obtained from generation to generation as the result of land clearing, sale and purchase, grant and inheritance. Second, the practice of land sale and purchase conducted in Gunung Bintang Awai sub district is privately made. The society�s custom in conducting privately sale and purchase land is cheaper, faster and less in time consuming. It�s lack of Land Deed Officials (PPAT) therefore many transfer of land rights are made without authentic deed is considered strong enough as it witnessed by the village chief and uses receipt as evidence. Third, the Regional Land Registry Office in South Barito Regency receives the Statement Letter of Land Physical Occupation and the receipt of land sale and purchase as initial evidence for the land registration. Fourth, legal consequences of privat land sale and purchase made by using the title of Statement Letter of Land Physical Occupation in Gunung Bintang Awai sub district is still legal, whereas to fulfil the administration requirement for land alienation registration, the deed should be made in front of Land Deed Official in the form of official document.
