- This research aims to outline the existence of the principle of equality in a power purchase agreement, particularly associated with existence in purchase agreement. And the next goal is to investigate the application of the principle of equality in the manufacture of power purchase agreements (PJBTL) at PT. PLN (Persero) area of Banjarmasin. The method used in this study is that a normative legal research procedures of scientific research to find the truth based on the logic of the normative legal views. Research that uses primary data and secondary data. From the data analysis using the method of qualitative analysis. Qualitative analysis method is a method of data analysis by grouping and sorting the data obtained from the study, and then developed with theories derived from the research literature in order to obtain answers to the problems posed. The research found that: First, the existence of the principle of equality in the purchase agreement is very important and a requirement legal purchase agreement. Intended to equality the principle of balance of bargaining positions of the parties in determining the rights and obligations under the purchase agreement. The aim is that the rights and obligations of the parties are protected. Equality principle criteria include: balanced act of the parties
