protection toward the parties interested in the agreement of the conferral of
fiduciary document guarantee number 10 of 2010 as well as finding out and
examining the role of notaries in extending law protection to the parties casted in
the fiduciary document number 10 of 2010.
This study is an empirical juridical law study, a study that focuses on the
field study to obtain primary data. This study of law is an empirical juridical
study, in which an analysis using qualitative measures focused on the substance is
used and the reasoning process in drawing the conclusion uses the deductive
thinking method, that is based on the submission of major premisein the form of
law regulation followed by the submission of minor premise in the form of law
fact, in which from both of them the conclusion is drawn.
Based on the result of the study, the law protection toward the parties
included in the agreement of the conferral of fiduciary document guarantee
number 10 of 2010, the writer chose to use the preventive law protection that only
refers to the law and the study is limited to the law protection toward the parties
included in the agreement of the conferral of fiduciary document guarantee
number 10 of 2010, rather than the execution of objects in consequence of default,
whereas the role of notaries in extending law protection to the parties casted in the
fiduciary document number 10 of 2010 is to make authentic document which is a
document that has an absolute verification power, especially since the document
contains the agreement tying up both parties that created the agreement, which
means that should a lawsuit happen between parties that created the agreement,
what is mentioned in the document constitutes perfect evidence that does not need
to be proven using other authentication instrument, as long as no other party is
