- This research aims at three principal cases namely: First, to determine if the clause on the CSR can be included in the company deed of establishment, Second, to observe the impact in presence of the CSR for PT. Swakarsa Sinarsentosa, and Third, to observe implementation of the CSR in PT.Swakarsa Sinarsentosa. This research is empirical or sociological laws research, which try to investigate the law effectiveness in form of the CSR obligations contained in the positive law in Indonesia and its influence toward PT. Swakarsa Sinarsentosa and the community. Data collection was conducted through the primary data processing, through interviews, observations, and reports in documents form. Data have been obtained will be analyzed in the qualitative descriptive analysis. The results obtained are as follows: 1) The CSR clause can be included on the Company deed of establishment, but merely as the assertion in one of the chapter. 2) The impact of the CSR for PT. Swakarsa Sinarsentosa can be divided into internal and external impacts, 3) In PT. Swakarsa Sinarsentosa the CSR is part of the Company operations. Focus of the CSR program in PT. Swakarsa Sinarsentosa is improving the moral and spiritual quality, education, health, entrepreneurship, gardens partnerships, infrastructure, arts and culture, and recruitment of the local labor. The implementation obligations of CSR was existed with the Directors obligation to make an annual work plan. Internally, the CSR brings benefits and challenges to establish the personal/legal subjects who make decisions on behalf of the Company based on the spirit and values existed in the CSR. Externally CSR brings the challenges through conflict management and the benefits is the presence of social investment. In PT. Swakarsa Sinarsentosa the implementation of CSR is sustainability, not charity.
