- This research aims to give a benefit discourse for the wider community about process of the inheritance division process that occurs in the mixed marriages or between nations, about how the division process and what nation to use for its division. This research is an empirical study of the juridical field research, reinforced by the library research. The data being used in this research are primary and secondary data. Primary data are obtained through field research by conducting interview with respondents. Secondary data are obtained through library research by studying primary, and secondary legal materials. The data collected are analyzed using qualitative analysis and are presented in a descrip tive report. Based on the results and direct interviews of the authorn with the Indonesian Woman Club in marriage between nation Srikandi in Jakarta, is to the couple different in citizenship who already have a children then the inheritance division in mixed marriages is closely related to where the bride different in citizenship hold the marriage. If the marriage took place in Indonesian then the inheritance division is done based on the Civil Code and the applicable law in Indonesia, when the marriage took place in another nation, the inheritance division based on the laws and regulations in the country. In addition to related with the laws where the marriage took place the division of inheritance in the mixed marriage is also related to whether in the marriage is contained in a Pre Nuptial Agreement. If there is a pre nuptial agreement in mixed marriage that took place in Indonesia, it make easier in the future to manage everything related to division of inheritance especially regarding to the land or houses formed inheritance.
