- Research on the the transfer of authority on the making of cooperative establishment deed to the Notary in accordance with the Decree of the State Minister of Cooperative and Small and Medium Enterprises Number: 98/KEP/M.KUKM/IX/2004 was aimed at identifying the roles and position of the Notary in the establishment of Cooperative in regard to the Decree of the State Minister of Cooperative and Small and Medium Enterprises Number: 98/KEP/M.KUKM/IX/2004 This research employed juridical-normative research method, that relied on the library research aimed at collecting secondary data from several law material sources, namely primary law material, secondary law material and tertiary law material. In order to support this library research, several resource persons were selected in order to give primary data, that was the opinion of the resource persons related to the subject matter. It is expected that the result of result could give descriptive-analytical explanation about the subject matter, that is describing and analyzing the condition of the problem object holistically and systematically based on the obtained data and eventually could provide solution the problems. The result of research indicated the roles of the Notary in the establishment of cooperative were mediator of the parties in formulating their will into the deed, consultant, mediator between cooperative and banking. There is discrepancy between the Decree of the State Minister of Cooperative and Small and Medium Enterprises Number: 98/KEP/M.KUKM/IX/2004 and Act Number 25 of 1992 and Act Number 30 of 2004. As long as Act Number 25 of 1992 is not revised, the making of either authentic or unnotarized deed of Cooperative establishment is still the choice. In addition, the profession of the Notary of Cooperative Deed Maker is not mentioned in Act Number 30 of 2004. The duties of Cooperative Deed Maker Notary are in the scope of duties and authorities of the Notary.
