- This research aims to know the legal basic of determination the status of Bank Century as the failed bank on systemic impact, knowing the legal implications of determination the status of Bank Century, and process bailout Bank Century by LPS. This research is normative legal research, i.e research based on the library research to gain secondary data in the field of law and also conducted field research to complete data obtained from the library. Furthermore, the various data obtained was processed in the form of descriptive analytical reports. According to the results of research and discussion have done, it can be concluded: A. The legal basic of determination the status of Bank Century as the failed bank on systemic impact is Indonesia Bank Governor (GBI) letter to the Minister of Finance as Chairman Committee Finance Stability System (KSSK) No. 10/2/GBI/DPNP/Rahasia on November, 20 th , 2008. In the letter, GBI describes the recent condition about Bank Century. This is due on implementation of Act No. 3 of 2004 junto. Act No. 24 of 2008. B. BI and KSSK hand over the management of BC to LPS through a meeting with Coordinating Committee (KK) by decree KK No. 01/KK.01/2008 as the implications of establishment of Bank Century�s status as a failed bank on systemic effect in accordance to the paragraph 3 of Article 21 of Act LPS. C. LPS in handle Bank Century, can be done with/ or without the involvement of shareholders (open assitence bank), do the Temporary Equity (PMS) or merger with another bank. Furthermore, LPS did bailout to BC with a number of Rp 6,762,361 trillion.
