- This research aims to find about The Implementation of Legal Protection of Intellectual Property Rights towards Anjat craftsman in Eheng Village West Kutai District. From the purpose of this research, researcher formulated several issues such as: How the recent implementation of legal protection in the perspective of copyrights legislation towards Anjat craftsman in Ehen Village West Kutai District, what kind of obstacles that occurred during the implementation of legal protection towards Anjat craftsman in Eheng Village West Kutai district and what things should be done to overcome these obstacles. This research could be categorized as empirical-normative research and the analytical process is descriptive-qualitative. The data collection process is performed by using field observation, such as interviewing people who have close relation to the research object. By observing the result of this research, it shows that The Implementation of Legal Protection of Intellectual Property Rights toward Anjat craftsman in Eheng Village West Kutai District is difficult to be conducted through the perspective of Legislation number 19 of 2002 related to Copyrights. However, the legal protection towards Anjat Craftsman more accepted through local government which is through West Kutai District law number 24 of 2001 related to empowerment, preservation, protection, and development of local custom and local custom institution within West Kutai District area. The obstacles that occurred on The Implementation of Legal Protection of Intellectual Property Rights toward Anjat craftsman in Eheng Village West Kutai District are no formulation of custom society or indigenous society stated on the Legislation number 19 of 2002 related to copyrights, the content of folklore protection clause is tend to contradict with other clause, the uncertainty of government institution which should represent the government on administering the folklore, and the lack society awareness on preservation culture process. The attempts that could be conducted in order to overcome the obstacles on the Implementation of Legal Protection of Intellectual Property Rights toward Anjat craftsman in Ehegn Village West Kutai District are speed up the establishment of particular legislation or law especially which refers to characteristic and life philosophy of Indonesian Nation, local government and non-governmental institution should cooperate with local custom institution on socializing the intellectual property rights (HaKI), immediate documentation of folklore in West Kutai District, and inserting the folklore into formal education curriculum in order to aware people about the important of local culture.
