- This research is aimed to understand gold auction�s implementation as Rahn object at Syariah Auction Kalibutuh Branch of Surabaya and surplus benefit management as marhun gold auction�s implementation observed from syariah principe perspectives. This research is empirical juridic, namely research that describe the points in the authorized role correlated with the existed reality in the field. The data that used in the research is primary and secondary data, namely data that obtained from field research through interview and library research as document study. Obtained data are analyzed qualitatively and reported as the result of the research report in the descriptive shape. The result of the research shows that : (1) The implementation of gold auction as Rahn object at ABSTRACT Syariah Auction Kalibutuh Branch of Surabaya is auction execution process. Rahn object or gold marhun that is not paid back by the customer (rahin) in the certain phase and agreed by all parties, will be aucted by Syariah Auction parties to fulfil rahin obligation to the Syariah Auction. The implementation of the auction theoretically or practically has been appropriately placed with syariah principe. (2) The money from gold rahn object auction at Syariah Auction Kalibutuh Branch of Surabaya is rahn right as the owner of the rahn object. As appropriately with agreement, if in the one year phase the object are not paid back or taken, so the Syariah Auction Kalibutuh Branch of Surabaya side will channel the money as shodaqoh. In the surplus money tasharuff progress, the position of Syariah Auction is as the vice of the rahin as the right owner of the surplus money, so wakalah agreement will take place.
