  • Nutrition service is one of the pillars in health services. Everyone has a right to get health service which is one of the basic rights. This means that a patient's right to get nutrition service has to be guaranteed and even legally protected. Malnutrition experienced by patients in hospitals shows that the nutrition service remains bad in the hospitals. A good nutrition service requires coordination between the existing policies and the hospitals’ resources. The objectives of this study were to obtain a description of nutrition service policy in hospitals, the implementation of nutrition service policy in relation with patients' rights protection in hospitals, and to find the factors influencing the implementation of legal protection for the patients’ rights in getting nutrition service in hospitals. This research applied socio-legal approach and used analytical descriptive specification. The data were gathered from four hospitals in Semarang City. The data were then qualitatively analyzed. The results of the research showed that the legal protection of the patient's right in getting nutrition service at the hospitals had been fulfilled by the policies and the existing legislations regulating it. The existence of policy of nutrition service of the hospitals became reference for nutritionists in providing good nutrition service and legal protection for patient’s right in getting the nutrition service. The legal basis of the legal protection for the patient was the Act on Health and Health Ministry Regulation. The judicial factors affecting were in the forms of policies and its derivatives, the number of Procedure Operational Standards (POSs) and socialization. The social factors affecting appeared in the form of patient’s and/or family’s behavior, education level, communication between nutritionists and medical doctors whereas the technical factors appeared in the form of limited nutrition, available nutrition facilities and infrastructure.
