- Consideration of judges is one of the factors that influence a decision. The judge who ruled must take full responsibility for the realization of legal certainty for the community. The formulation of the issues raised in this thesis are: What factors are taken into consideration in decisions criminal judge and rehabilitation of perpetrators of criminal acts of drug abuse? This type of research used in this thesis is the kind of normative legal research, the research used by examining secondary data in the form of primary legal materials and secondary legal materials. The analytical method used is qualitative analysis and using deductive reasoning. The conclusions of this study are to be considered from a judge in a criminal verdict or rehabilitation is the presence of a doctor’s certificate or the assessment team that the defendant should be in rehab.
