- The bankrupt debtor has assets not only in Indonesia but also abroad. The facts show that executing the assets of a bankrupt debtor residing abroad encounters many difficulties and is ultimately not executed. The problem in this legal research is about how position of the assets of the bankrupt debtor who is abroad if it is not executed by curator. This legal research will using normative legal research methods or normative jurisdical legal reasearch methods. The data used in this legal research are secondary data with primary legal materials and secondary legal materials. The result of this legal research can be conclude that the position of the assets of the bankrupt debtor who is abroad if there is no execution by the curator then position remains the assest of the debtor. Even if the bankruptcy process has been complete, the assets of the bankrupty debtor outside the territory of Indonesia remain the property of the debtor.
