- The implementation of post-mining obligations that is carried out in the long term after the mine closure process is very important in terms of environmental prevention, aimed at restoring environmental damage. The role of the company is very important in conducting post mining, especially in terms of accountability for environmental restoration. There are two legal problems in this research, namely how is the implementation of post-mining obligations as an effort to restore environmental damage in West Kutai Regency? Second, what are the obstacles in the implementation of post-mining obligations as an effort to restore environmental damage in West Kutai Regency? This legal research is an empirical legal research that focuses on social facts, and data collection through interviews and literature studies. The conclusion of this research is the company PT. KEM has carried out post-mining activities in restoring environmental damage properly. In addition, the mining areas that have been converted into protected forest under the supervision of PT. HLKL are also monitoring the two abandoned mining dams. Therefore it is suggested that companies, government and society can cooperate in restoring environmental damage.
