- The problem of this research was about the protection of refugees from Afghanistan in Indonesia especially in Kalideres, Jakarta. In handling refugees who are finding country. The problem is Indonesia is not a party to the Genewa Convention and it is basically Indonesia did not have an obligation to manage refugees, so many refugees who lives in a stranded in Indonesia but that the aids, and protection afforded by the Indonesian government in handling refugees in Indonesia is based on humanitarian reasons. This study was a normative legal research, the data were collected by study documents and some interviews with the officials who are experts in their field. From the data analyzed it could be concluded that Indonesia has been and will continue to provide humanitarian assistance beyond their condition ( extra-miles) as long as the refugee waiting until they get ressetlement and UNHCR with the government of Indonesia needs to increase cooperation in dealing with refugees in Indonesia.
