- Although the construction of the prisoners have been executed in accordance with applicable regulations but in fact there still a presence of repetitive or recurrent criminal, often called residivist. These criminals usually commit the same crimes, although the punishment has been imposed for their crimes. Based on the fact above, author formulated title form : Construction of Residivist in Class IIA Penitentiary of Yogyakarta Regency. The purpouse of this research is to obtain data about causatives factor of residivist and how to construct the residivist. The method used in this research is the normative law method; that is the use of the secondary data as the main data in the form of primary and secondary law materials. The data analysis uses the qualitative method and the deductive framework. The result of this result show that the construction of residivist are same with general prisoners. Causatives factor of residivist be divided in two category : Intern factor and Ekstern factor. The resticting factors of residivist construction are budget, prisoners’s motivation and infrastructure.
