- Morality norm is frequently comprehended as social norm which places less emphasis on legal certainty. This assumption is not complete indeed. Philosophical understanding on prohibition of crime act in morality sphere always upholds humanity value which contains justice and civility. Study result indicated that legislators have been trapped in positive law paradigm in formulating internet pornography crime. Fulfillment of crime act element in Article 4 of Pornography Law becomes so important to reproach a crime act by setting aside prevailed social norm in society. As a result, law implementation run mechanistically without bearing Pancasila values in mind where they should be contained in consideration of judge verdict. This condition can be solved by law comprehension synergy in such ways of not making positive law provision as mere basis but also morality value which derived from Indonesian individual appreciation.
