- Research has been carried out to study several factors - especially seen from the social perspective, what kind of social factors play important role in the passing of No. 2 Regulation of the Local Government Year of 2014. The Regulation instructed on the eradication of localized prostitution in Jambi,as one of the actions taken on the eradication of prostitution and sexual misconduct.Maqashid Asy-Syariah at first,were thought to be the mainreason that pushesthe passing of the regulation, but the researcher think that not all regulation related to the Islamic religion or sharia are practiced based only on sharia regulations alone, but also influenced by other factors. Thus, the purpose of the research is to find out what other factors, especially social ones that play important role in the passing of the regulation. It was found that social factors in the form of community’s opinions on the prostitution plays important role in the regulation’s passing. The community where the localized prostitution locatedare already exasperated with drug abuses, alcohols using and gambling that came along with the prostitution, they then appealed to the local government to consider the shut down of theprostitution localization. Theiropinion, along the supports from religious leaders and members of the House of Representatives,play important role in the passing of the regulation. The localized prostitution closings and the obliteration of any other kind of prostitution practices are realized as an effort to reduce the practice ofwrongdoingsand to greatly benefit the communities.Reducing the practice of wrongdoings to greatly benefit the communities is part of darurineeds. Daruri needsare parts of the main principle that need to be uphold by every Muslims, such asreligion preservation, nafs descendants, wealth and aql preservation from all wrongdoings.Artikel dari hasil penelitian ini mendiskripsikan tentang berbagai faktor sosial yang melatar belakangi lahirnya Peraturan Daerah (Perda) No. 2 tahun 2014 tentang Pemberantasan Pelacuran dan Perbuatan Asusila di Jambi, yang juga menelisik dari pendekatan maqashid syariah. Penulis menemukan sebuah argumen baru bahwa tidak semua Perda bernuansa syariah hanya berorientasi pada syariah (ansich), atau hanya untuk kepentingan politik praktis. Berbagai faktor sosial tampil mengiringi desakan terbitnya Perda ini, di mana kondisi tempat prostitusi yang memang sudah nyata-nyata melanggar norma-norma agama, sosial, adat dan hukum negara yang berlaku, yang di lokasi itu juga terboncengi oleh praktik penggunaan narkoba, minuman keras, dan perjudian. Karena itu argumen dari kalangan DPRD dan tokoh agama di Kota Jambi untuk menerbitkan Perda, sehingga lokasi prostitusi dapat ditutup adalah untuk menghilangkan sumber kemudharatan dan menegakkan kemaslahatan umat manusia, yang merupakan kebutuhan daruri, sebagaimana tertuang dalam prinsip utama yang harus dipelihara umat manusia yaitu: memelihara agama (al-din), jiwa (al-nafs), keturunan (an-nasl), harta (al-mal) dan akal (al-aql).
