- AbstractOn this occasion, the author will be put through further research in connection with the enactment of the Criminal Justice Act No. 11 of 2012 Children enacted in 2014 ago. Based on this, the authors will conduct further research on the Status of Children in Conflict with the Law as Actors Crime. The research method uses the type of normative juridical research with nature descriptive analytical study through approach law (statute approach) using a literature study data collection tool to obtain secondary data derived from primary legal materials and secondary legal materials with field data supported the form of interviews with agency related laws. In accordance with the Convention on the Rights of the Child which has been ratified by Indonesia through Presidential Decree No. 36 In 1990, the Indonesian should have been committed in the protection of children's rights as a whole. In addition, Indonesia also has to have Law No. 23 of 2002 on Protection of Children as an effort to provide the protection of the rights of children in areas such as education, health, religion, and social, including the rights of children in conflict with the law. Children in conflict with the law, including the criteria given in the Special Protection as stated in Article 59 of Law No. 23 of 2002. It is the responsibility of the government and society. Article 64 of Law No. 23 of 2002 states further that the protection of children in conflict with the law covers children in conflict with the law and child victims of crime. This research is the development of legal theory Children Who Faced with the Law and the concept of Diversion and Restrorative Justice (restorative justice) which broadly provide protection for the child's best efforts. Keywords: Children in conflict with the law, diversion, restrorative justice AbstrakPada kesempatan ini, penulis akan melalukan penelitian lanjutan sehubungan dengan berlakunya Undang-Undang Peradilan Pidana Anak Nomor 11 Tahun 2012 yang diberlakukan pada Tahun 2014 yang lalu. Berdasarkan hal tersebut, maka penulis akan melakukan penelitian lanjutan tentang Kedudukan Anak Yang Berhadapan Dengan Hukum selaku Pelaku Tindak Pidana. Metode penelitian menggunakan tipe penelitian yuridis normatif dengan sifat penelitian deskriftif analistis melalui pendekatan undang-undang (statute approach) dengan menggunakan alat pengumpul data studi kepustakaan untuk memperoleh data sekunder yang bersumber dari bahan hukum primer dan bahan hukum sekunder dengan didukung data lapangan berupa wawancara dengan instansi hukum terkait.Sesuai dengan Konvensi Hak Anak yang telah di ratifikasi oleh Indonesia melalui Keputusan Presiden No. 36 Tahun 1990, maka seyogyanya Indonesia telah berkomitmen dalam upaya perlindungan hak anak secara keseluruhan. Disamping itu, Indonesia juga telah mempunyai Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak sebagai satu upaya dalam memberikan upaya perlindungan terhadap hak-hak anak seperti di bidang pendidikan, kesehatan, agama, dan sosial termasuk hak anak yang berhadapan dengan hukum. Anak yang berhadapan dengan hukum termasuk dalam kriteria yang diberikan Perlindungan Khusus seperti yang di nyatakan dalam Pasal 59 Undang-Undang Nomor 23 Tahun 2002. Hal ini merupakan tanggung jawab pemerintah dan masyarakat. Pasal 64 Undang-Undang Nomor 23 Tahun 2002 menyatakan lebih lanjut bahwa perlindungan anak yang berhadapan dengan hukum meliputi anak yang berkonflik dengan hukum dan anak korban tindak pidana. Penelitian ini merupakan pengembangan dari teori hukum Anak Yang Berhadapan dengan Hukum dan konsep Diversi serta Restrorative Justice (keadilan restoratif) yaitu secara garis besar memberikan upaya perlindungan untuk terbaik anak.
