- Every person have equal rights in obtaining optimal healthy degree. Rights realization above optimal healthy degree is aimed to each people, and in this matter is patient in medical and healthy service. In medical service, position and role of doctor is very significant, which ideally doctor in giving medical service is to give welfare to his patients, but among hopes and reality sometimes are not run well, frequently happened doctor conduct any mistakes or dereliction in running his profession in giving medical service with severe cause to patient, so it emerges lost to patients caused by doctor's dereliction. Consequence of dereliction in giving this causes service can raise law problem, and doctor also hospital able to be claimed based on both achievement or act against law.
