Klausul ekspropriasi merupakan salah satu kalusul penting dalam BIT guna melindungi hak investor asing dari perampasan property secara langsung maupun kerugian lain yang mungkin timbul. Ekspropriasi terbagi menjadi indirect expropriation dan indirect expropriation.
