Sertipikat sebagai alat bukti terkuat ternyata tidak menjamin dapat di jadikan alat bukti
yang dapat secara penuh di miliki ini di buktikan dengan di batalkannya Hak Tanggungan
No.5/HT/18/IV/199 oleh pengadilan. Akibat di batalkannya Akta Jual Beli Tanah yang
menjadi obyek jaminan hak tanggungan sehingga menyebabkan hapusnya obyek jaminan hal
ini tentu saja merugikan pihak kreditur karena pihak kreditur yang beitikad baik yang telah
memenuhi segala ketentuan untuk memberi pinjaman tidak mendapatkan perlindungan
karena haknya telah di cederai dengan di batalkannya hak tanggungan tersebut karena
batalnya sertipikat jual beli tersebut.Sehingga dalam hal ini penulis ingin meneliti dan
mengkaji bagaimana peristiwa tersebut dapat terjadi bagaimana kekuatan perjanjian yang di
lakukan sebelum AJB di buat apakah mempunyai Implikasi yang besar terhadap pembatalan
sertipikat kedua tanah tersebut sehingga mengakibatkan batalnya hak tanggungan .tesis ini di
buat untuk dapat mengetahui factor apa saja yang dapat membatalkan sertifikat sehingga
penulis mengharapkan dapat mengklarifikasi penyebab batalnya hak tanggungan yang di
sebabkan batalnya sertifikat akibat akta jual beli yang batal di masa yang akan datang.

<b>ABSTRACT</b><br>
Certificate as the strongest evidence did not ensure that the evidence can be
made in full to have this attested by at cancellation of Mortgage No.5/HT/18/IV/199
by the court . Due on Sale and Purchase of Land Deed canceled the object of causing
collateral mortgage guarantee this object abolishment of course detrimental to the
creditors because the creditors are faith both have met all the provisions to provide
protection because the loan did not get in to harm the rights have been in cancellation
the encumbrance certificate for the cancellation of the sale and purchase. in this case I
want to examine and assess how such events can happen how the strength of the
agreement will be undertaken prior to AJB is made whether to have great
implications on both the soil certificate cancellation , resulting in the cancellation of
mortgage . thesis is made in order to determine what factors may cancel the certificate
so that the author hopes to clarify the cause of the cancellation of mortgage that is
