- <b>ABSTRAK</b><br> Dokumen asing untuk mendirikan perusahaan penanaman modal asing dapat diterima atau berlaku di Indonesia apabila telah melewati prosedur otentifikasi atau legalisasi berdasarkan hukum Indonesia. Namun proses legalisasi itu sangat berantai dan tidak efektif dikarenakan dokumen-dokumen itu harus diotentifikasi oleh lebih dari satu instansi di negara tempat dokumen itu diterbitkan. Prosedur otentifikasi seperti itu seharusnya ditinggalkan dan beralih ke sistem Apostille dengan mengaksesi Convention Abolishing The Requirement of Legalisation For Foreign Public Documents 1961. Pada dasarnya Tujuan penelitian ini adalah untuk menggambarkan permasalahan legalisasi dokumen asing dan merekomendasikan penggunaan sistem Apostille itu di Indonesia. Adapun metode penelitian yang digunakan adalah metode penelitian normatif. <hr> <b>ABSTRACT</b><br> Foreign documents to establish a foreign investment company is acceptable or applicable in Indonesia if the procedure of authentication or legalization has passed under Indonesian law. But it is a chain process of legalization and ineffective because the documents must be authenticated by more than one institution in the country where the document was issued. Such authentication procedure should be abandoned and the system switches to accede to the Convention Apostille by abolishing the Requirement of Legalisation For Foreign Public Documents, 1961. Basically the purpose of this study was to describe the issue of legalization of foreign documents and recommend the use of the Apostille system in Indonesia.
