Banyaknya kasus pasien yang merasa tidak puas terhadap pelayanan kesehatan
di rumah sakit dan adanya kejadian tidak diharapkan (adverse evem)
yang dialami oleh pasien, menunjukkan masih banyak pasien yang belum
memperoleh haknya saat menerima pelayanan kesehatan. Ha1 ini merupakan
masalah yang mencuat akhir-akhir ini. Untuk mengatasi hal tersehut, pemerintah
telah menetapkan beberapa kebijakan, antara lain adanya UU Rumah Sakit No.44
tahun 2009 yang bertujuan agar hak-hak pasien dapat terlindungi. Namun
kebijakan tersebut belum sepenuhnya terlaksana seperti yang diharapkan.
Penelitian ini bertujuan untuk menganalisa kesiapan RSU Kabupaten
Tangerang dalam melaksanakan kebijakan perlindungan hak pasien sesuai dengan
UU Rumah Sakit No. 44 tahun 2009.
Penelitian ini menggunakan metode kualitatif dengan cara mengumpulkan
data primer dan sekunder melalui wawancara mendalam dengan 14 informan,
telaah dokumen kebijakan dan observasi. Teknik analisis data yang digunakan
dalam penelitian ini adalah analisi isi (content analysis). Dari penelitian diperoleh
hasil bahwa 1). elemen sumber daya manusia belum sepenuhnya dikatakan siap
pada aspek jumlah tenaga keperawatan terutama di instalasi rawat inap
berdasarkan standar Kepmenpan No.75 tahun 2004 dan Permenkes No.340 tahun
2010. Efisiensi dan mutu pelayanan masih kurang baik, berdasarkan penilaian
tingkat kesehatan rumah sakit tetapi ada upaya yang dilakukan antara lain
rekruitmen tenaga kerja kontrak (TKK) sccara bertahap. 2). elemen dana belum
sepenuhnya dikatakan siap karena pada penyusunan Rencana Bisnis anggaran (
RBA) belum disesuaikan dan ditujukan untuk pemenuhan hak pasice oleh karena
UU Rumah Sakit No. 44 tahun 2009 pasal 32 belum disosialisasikan, meskipun
dalam penyusunan Rcncana Bisnis Anggara ( RBA) dan Rencana Kerja Tahunan (
RKT) yang dilaksanakan setiap tahun secara tidak langsung dapat memenuhi
beberapa butir hak pasien. 3). elemen sarana dan prasarana belum sepenuhnya
dikatakan siap karena jumlah dan kondisi sarana dan prasarana yang tersedia
masih ada yang kondisinya kurang baik dan tidak lengkap tetapi ada upaya yang
dilakukan antara lain menyediakan tempat komplain pasien di Instalasi Hukum,
Publikasi, dan Informasi (HPI), pembangunan fisik ruang rawat inap kelas tiga
dan pembelian alat-alat kesehatan. 4). elemen metode/tatacara sudah cukup
memadai meskipun peraturan internal rumah sakit yang berkaitan langsung
dengan UU Rumah Sakit No. 44 tahun 2009 belum dikeluarkan tetapi prosedur
dan tata cara yang lain sudah tersedia pada setiap unit pelayanan kesehatan.
Diperlukan komitmen manajemen RSU Kabupaten Tangerang untuk
mensosialisasikan UU Rumah Sakit No. 44 tahun 2009 kepada seluruh tenaga
medis dan non medis serta menyusun peraturan internal rumah sakit (Hospital By Law).
Advokasi kepada Pemerintah Daerah Kabupaten Tangerang untuk dapat
mengangkat tenaga kerja kontrak (TKK) rumah sakit menjadi Pegawai Negeri
Sipil, menempatan tenaga keperawatan baru, memberi bantuan anggaran untuk
pembangunan sarana/prasarana dan bantuan alat-alat kesehatan.

patients to the service delivered by hospitals, and the occurences of adverse
events. A "tip of iceberg" phenomena that become very popular recently. The
govemment has issued several policy regarding this problem, one of which is UU
Rumah Sakit No.44 tahun 2009 that aims to ensure patients" rights being
protected. Nevertheless, on implementation term, this policy performs not as good
as expected.
