- [Sengketa tumpang tindih pemilikan hak atas tanah dapat disebabkan oleh beberapa faktor yaitu ketidakcermatan dan ketidaktelitian dari pihak Kantor Pertanahan dan belum terselenggaranya tertib administrasi pertanahan. Dari hasil analisa penelitian ini apabila terjadi sengketa tumpang tindih pemilikan atas satu bidang tanah, maka salah satu harus dibatalkan. Yang menjadi permasalahan dalam penulisan tesis ini adalah untuk mengetahui penyebab timbulnya sengketa tumpang tindih kepemilikan tanah di Kabupaten Bone yang diajukan pendaftaran pertama kali, upaya penyelesaian sengketa melalui proses pengadilan terhadap putusan Mahkamah Agung RI No.376 K/TUN/2008 sesuai dengan peraturan perundang-undangan yang berlaku. Penelitian ini dianalisis secara deskriptif dengan menggunakan pendekatan yuridis normatif. ;Overlapping ownerships of land rights dispute can be caused by numerous factors which are inaccuracy registration by the land officers and there is no discipline of land registration. As a result of this research analysis, if the land rights dispute occurs, one of the land rights ownerships should be cancelled. The research has a function to answer the main problems as follows; causes of overlapping ownerships of land rights dispute in Bone district which initially registered and litigation dispute processing by the supreme court of Republic Indonesia through the verdict No.376 K/TUN/2008.
