- The research is aimed to analyze the application of occupational health and safety protection to child laborers and analyze the obstacles that may occur in the application of occupational health and safety protection to child laborers in Tobacco Plantation in Garut, West Java. This research is an empirical legal research, which is conducted by looking at the law in a real sense in the scope of society, which is primary data and legislation as secondary legal material. So the approach taken is a case approach and a statute approach. Based on an analysis of Indonesian laws and regulations governing the protection of child labor, the following forms of protection for child labor are found: prohibiting the recruitment of child labor, but exceptions such as: ages between 13-15 years of age to do light work as long as it does not interfere with the development and physical, mental and social health of the child; written permission from parents or guardians; employment agreement between the employer and parents or guardians; maximum working time of 3 (three) hours; carried out during the day and does not interfere with school time; occupational Health and Safety; a clear working relationship; and receive wages / salaries in accordance with applicable regulations. Based on this research it can be concluded that the very lack of occupational health and safety protection for child laborers and the lack of implementation of occupational health and safety in the work environment. In addition, obstacles that may occur are the lack of awareness of child labor, the desire of child workers to know about health and safety at work and the absence of supervision from the Department of Labor on the implementation of occupational health and safety.
