  • Consumer protection is an effort to guarantee legal certainty for consumers related to their rights, as well as for business actors related to their obligations to consumers. The Consumer Protection Law was established to improve the dignity and status of consumers and to ensure that businesses actors are responsible for the goods that they sell. Consumer protection law imposes many obligations that must be fulfilled by business actors, one of which is the obligation to provide spare parts as stipulated in Article 25 of the Consumer Protection Act (CPA). Article 25 paragraph (1) of the CPA states that "Business actors who produce goods whose the use is sustainable within a limit of at least 1 (one) year are required to provide spare parts and/or after-sales facilities and are required to fulfill warranties or guarantees as promised". The wording in the provisions of Article 25 paragraph (1) of the CPA rise multiple interpretations regarding how long the business actor must provide spare parts. Legal certainty related to the period of business actor obligation in provide spare parts is important to ensure that consumers obtain goods that have sustainability on its utilization. It is also important for business actors to provide certainty for them about how long business actors must provide these parts, which is related to the investment and the costs they have to reserve to provide the parts. This research will be conducted using normative juridical method, with a descriptive analytical explanation. The analysis in this study will be based on the relevant literature, including by referring to the minutes of the meeting of the CPA forming as well as a comparison with the provisions which applicable in other countries.
