- Сучасні ризики національної та інформаційної безпеки України, зумовлені впливом комплексу соціально-демографічних, економічних, політичних, правових, психологічних і технологічних факторів та вимагають системного реагування, адекватної трансформації сектора безпеки. Тому для повноцінного розвитку держави і забезпечення належної національної (НБ) та інформаційної безпеки (ІБ) необхідно якісне і результативне державно-правове забезпечення. Сучасний стан законодавчої основи забезпечення НБ та ІБ можна визначити як стан системи, що знаходиться в стадії формування, а тому неминуче несе якості перехідного етапу. Ефективне забезпечення НБ та ІБ залежить від багатьох факторів. Значення має розроблена теоретико-методологічна основа розуміння феномену НБ та ІБ в науці і його нормативне правове закріплення. Роль законодавства в сфері забезпечення НБ та ІБ пов'язана зі створенням умов для повноцінного функціонування держави в сучасному нестабільному світі. В даний час створена правова система забезпечення НБ та ІБ, проте прийняття нормативних правових актів не вирішило більшості теоретичних і правових проблем в регулюванні питань НБ та ІБ. Дублювання, відсутність системності, суперечливість і декларативність – є головними недоліками законотворчої діяльності. In the article, scientists study the theoretical basis of the legislative framework in the field of national and information security. In Ukraine, as in many countries of the world, the problems of legal support of the security system of the state, society and the individual are becoming increasingly relevant in public policy and public administration. The full development of the state is impossible without the creation of proper public and legal support in the sphere of national and information security. Modern risks of national and information security of Ukraine, due to the influence of a complex of socio-demographic, economic, political, legal, psychological and technological factors and require a systemic response, adequate transformation of the security sector. Therefore, for the full development of the state and ensuring appropriate national and information security, high-quality and effective state-legal support is necessary. It is concluded that today, with a certain degree of conventionality, we can say that basically a legislative basis has been created to ensure national and information security. At the same time, the current state of the legislative framework for ensuring national and information security can be defined as the state of the system, is in the process of formation, and therefore inevitably bears a transitional stage. The effective provision of national and information security depends on many factors. Of importance is the developed theoretical and methodological basis for understanding the phenomenon of national and information security in science and its normative legal consolidation. The role of legislation in the field of ensuring national and information security is associated with the creation of conditions for the full functioning of the state in a modern unstable world. Nowadays, a legal system for ensuring national and information security has been created, but the adoption of regulatory legal acts has not solved most of the theoretical and legal problems in regulating national and information security issues. Duplication, lack of consistency, inconsistency and declaratory are the main shortcomings of legislative activity.
