- Resumo: O presente trabalho foi elaborado com a finalidade de inquirir a problemática da violação do direito à imagem nas mídias sociais (Internet), averiguando a responsabilidade civil do autor da ofensa e do site/provedor onde esta se deu. Para tanto, procederemos à conceituação destas novas mídias, discorreremos acerca do dano à imagem e examinaremos os polos ativo e passivo da relação obrigacional surgida a partir de tal violação. Abstract: This paper was prepared for the purpose of inquiring the issue of violation of the right image in social media (Internet), ascertaining the liability of the offender and of the website/server where the offense occurred. To do so, we will proceed to the conceptualization of these new media, we will discuss about the damage to the image and examine the active and passive poles of the obligation arising from such violation.
