Haryono No. 169 Malang e-mail: kailaadinda7@gmail.com ABSTRAK Perkembangan teknologi dan ilmu pengetahuan memberikan kemudahan dalam hal transaksi jual beli sehingga mempengaruhi Hak Kekayaan Intelektual dalam dunia digital. Salah satunya ialah perlindungan pada Hak Cipta di era globalisasi ini yang sifatnya lebih kompleks dan beragam. Hal-hal tersebut memberikan dampak terhadap kemudahan akses dalam transaksi jual beli contoh seperti pada marketplace. Namun, hal tersebut juga menciptakan pelanggaran-pelanggaran baru pada Hak Cipta di Indonesia. Jenis penelitian ini adalah Yuridis – Empiris dengan menggunakan pendekatan penelitian Yuridis - Sosiologis. Pengambilan data primer dengan metode wawancara dengan responden pihak penerbit, pihak penulis dan pihak konsumen. Sedangkan untuk memperoleh data sekunder, peneliti melakukan studi dokumentasi. Dari hasil penelitian dengan metode di atas, penulis memperoleh kesimpulan atas permasalahan yang ada bahwa perlindungan hukum preventif telah diberikan oleh Pemerintah Indonesia melalui Undang-Undang Hak Cipta Nomor 28 Tahun 2014 dan Peraturan Menteri Komunikasi dan Informatika Nomor 5 Tahun 2020 tentang Penyelenggara Sistem Elektronik Lingkup Privat, lalu pihak Marketplace sejak pertama kali menjelaskan terkait pembuatan akun melalui terms & conditions. Sementara perlindungan hukum represif yang mana pihak yang dirugikan dapat menyelesaikan sengketa nya melalui pengadilan. Perlindungan hukum preventif dan represif belum berjalan dengan masif karena masih memiliki hambatan baik hambatan yuridis maupun hambatan non yuridis sehingga upaya yang diharapkan oleh para narasumber ialah dibuat Undang-Undang turunan yang lebih efektif, terkait dengan sifatnya yang delik aduan sehingga para pihak penerbit maupun penulis dibantu oleh aparat dalam proses pelaporan, tersedianya dukungan dari pihak marketplace dengan disediakan filter terhadap akun yang pernah melakukan pelanggaran hak cipta agar tidak mengulangi tindakannya serta memberikan edukasi dan arahan masyarakat agar mengetahui Hak Kekayaan Intelektual. Kata Kunci: Pelaksanaan, Perlindungan Hukum Hak Cipta, Pemegang Hak Cipta, Pembajakan Buku, Marketplace ABSTRACT The advancement of technology and science has opened access to transactions, affecting intellectual property rights in the digital world. It also touches on the matter of the protection of copyright in this globalization era in a complex and varied way. This development provides easy access to transactions in the marketplace, and it also carries the potential for new copyright infringement in Indonesia. This research employed empirical-juridical methods and socio-juridical approaches. Primary data were obtained from interviews with the respondents consisting of the publisher, author, and consumers. The secondary data were obtained from the documentation. The research results reveal that preventive protection is given by the Indonesian government under Law concerning Copyright Number 28 of 2014 and the Regulation of the Minister of Communication and Information Technology Number 5 of 2020 concerning Electronic Systems within Private Scope. The marketplace has elaborated the details of accounts in the terms and conditions. The repressive protection lies in the condition where the aggrieved parties settle this dispute in court. Both preventive and repressive protections cannot be optimally given due to juridical or non-juridical issues. Departing from this problem, this research recommends that effective successor law be made. Since this problem is categorized as a complaint offense, the publisher and author were assisted by authorities in reporting the case. The marketplace also provided a system filtering the account users previously committing copyright infringement. This approach is intended to stop repeated infringement and to educate and give knowledge to people about intellectual property rights.
