Veteran Malang, 65145 *Penulis Korespondensi, Email : andhanaharris258@gmail.com ABSTRAK Skripsi ini mengangkat tentang permasalahan hukum Penegakan Hukum Terhadap pasal 33 Ayat 2 Peraturan Daerah Kota Malang No.2 tahun 2012 Tentang ketertiban umum dan lingkungan hidup ( Studi Kantor Satuan Polisi Pamong Praja Kota Malang ). Pemilihan permasalahan hukum ini dilatar belakangi oleh banyaknya tindak melawan Peraturan Daerah kota malang yang merusak fasilitas pemerintah daerah Kota Malang yang dapat mencemari lingkungan Hidup. Pasal 33 Ayat 2 peraturan daerah kota malang no.2 tahun 2012 menjelaskan bahwa Setiap dan/atau badan dilarang: mencoret atau menggambar pada dinding bangunan pemerintah , bangunan milik orang lain, swasta, tempat ibadah, pasar, jalan raya , dan pagar. Untuk mengetahui efektif apa tidaknya permasalahan ini dapat dianalisis berdasarkan teori evektifitas hukum yang dikemukakan oleh Soerjono Soekanto, yang mengemukakan bahwa efektif dan berhasil tidaknya penegakan hukum tergantung lima faktor hukumnya itu sendiri, faktor penegak hukum, faktor sarana dan fasilitas, faktor masyarakat, dan faktor kebudayaan. Kata Kunci : efektivitas hukum , masyarakat, penegakan hukum ABSTRACT This bachelor’s thesis raises a legal issue on the Law Enforcement over Article 33 Paragraph (2) of Regional Regulation of Malang City Number 2 Year 2012 concerning Public Order and the Living Environment (A Study at Civil Service Police Unit Office of Malang City). The choice of legal issues is motivated by many actions against Regional Regulation of Malang City which damage the facilities of Local Government of Malang City which can pollute the environment. Article 33 Paragraph 2 of Regional Regulation of Malang City Number 2 Year 2012 states that every person and / or legal entity is prohibited to: streak repeatedly or drawing on the walls of government buildings, buildings owned by other people, private companies, places of worship, markets, roads and fences. To find out whether this problem is effective or not, it can be analyzed based on the theory of legal effectiveness proposed by Soerjono Soekanto, which states that the effectiveness and success of law enforcement depends on the five legal factors namely: law enforcement, infrastructure and facilities, community, and cultural factors.
