Haryono No. 169 Malang, Jawa Timur, 65145e-mail: zelyndaavelina@gmail.com AbstrakPenelitian ini bertujuan untuk mengkaji dan menganalisis kendala implementasi pasal 13 Undang-undang Nomor 11 Tahun 1974 tentang Pengairan yang dilakukan oleh HIPPAM kota Batu, serta mengkaji dan menganalisis upaya dan solusi dari HIPPAM dan Pemerintah Kota Batu dalam melakukan pengelolaan dan pemanfaatan sumber daya air di Kota Batu dalam rangka memberikan perlindungan hukum ketersediaan SDA bagi masyarakat Pemerintah Kota Batu. Berkaitan dengan Kendala Implementasi Pasal 13 Undang-undang Nomor 11 Tahun 1974 Tentang Pengairan ada faktor internal maupun eksternal yang dialami oleh HIPPAM maupun Pemerintah Kota Batu, dan masih banyak kendala yang dihadapi, ole karena itu HIPPAM dan Pemerintah kota Batu. Mereka memiliki upaya dan solusi baik preventif maupn represif dalam peningkatan di internal maupun eksternal yang sudah direncanakan dengan bagus, namun masih ada hal yang perlu diperbaiki lagi untuk menjaamin ketersediaan air guna perlindungan bagi masyarakat, yang harus bersinergi satu sama lain antara pemerintah, HIPPAM, dan masyarakat serta swasta.Kata kunci: Perlindungan hukum, air, HIPPAM. AbstractThis study aims to examine and analyze the obstacles in implementing Article 13 of Law Number 11 of 1974 concerning Irrigation carried out by Batu City HIPPAM, as well as assessing and analyzing the efforts and solutions of the HIPPAM and Batu City Government in managing and utilizing water resources in the City Batu in the context of providing legal protection for the availability of natural resources for the people of Batu City Government. Regarding the quality and quantity of natural resources caused by tourism and other activities, and the decrease in the quantity of one of the springs in the city of Batu. In connection with the Implementation Obstacle of Article 13 of Law Number 11 Year 1974 Regarding Irrigation, there are internal and external factors experienced by HIPPAM or the City Government of Batu, and there are still many obstacles faced, because of that HIPPAM and the City Government of Batu. They have efforts and solutions both preventive and repressive in internal and external improvements that have been well planned, but there are still things that need to be improved to guarantee the availability of water for protection for the community, which must synergize with each other between the government, HIPPAM, and public and private sector.Keywords: Legal protection, water, HIPPAM
