- Ahmad Fairuz Zazily Fakultas Hukum Univeristas Brawijaya Malang Email: afizahmadfairuz@gmail.com ABSTRAK Penelitian ini membahas seberapa efektif implementasi master plan untuk pengelolaan sampah domestik dalam kaitannya dengan Pasal Paragraf Peraturan Pemerintah Kabupaten Gresik Nomor 5 Tahun 2017 tentang Pengelolaan Sampah. Faktanya, volume sampah domestik meningkat dan tempat pembuangan akhir di Kabupaten Gresik di luar kapasitas. Volume limbah yang berasal dari rumah tangga sangat besar, dan ini gagal memenuhi keseimbangan antara peraturan yang ada, penegak hukum, fasilitas dan infrastruktur, masyarakat, dan rencana induk. Latar belakang tersebut menjadi landasan penelitian ini yang difokuskan pada efektivitas Pasal 7 ayat (2) huruf a Peraturan Daerah Kabupaten Gresik Nomor 5 Tahun 2017 tentang Pengelolaan Sampah Domestik terkait rencana induk. Selain itu, penelitian ini juga menggali lebih dalam faktor-faktor yang menghambat yang menghambat pelaksanaan rencana induk dan keefektifan artikel. Metode yuridis empiris bersama dengan pendekatan sosial-yuridis digunakan, di mana penelitian berlangsung di Pengelolaan Limbah Badan Lingkungan Hidup di Kabupaten Gresik. Data melibatkan bahan primer dan sekunder, di mana yang pertama diperoleh dengan melakukan wawancara langsung dengan informan, sedangkan yang kedua dilakukan dengan mempelajari literatur yang tersedia yang berasal dari hukum, para ahli dan sumber dari Internet, diikuti oleh analisis kualitatif-deskriptif dari data. Hasil penelitian mengungkapkan bahwa peraturan tersebut belum diimplementasikan secara efektif mengenai rencana induk pengelolaan limbah domestik, karena beberapa faktor yang berasal dari penegakan hukum, fasilitas dan infrastruktur yang mendukung penegakan hukum, masyarakat, dan budaya telah menyebabkan ketidakefektifan implementasi. Kata Kunci: Efektivitas, Peraturan Daerah Kabupaten Gresik, Rencana Induk Pengelolaan Sampah Rumah Tangga. ABSTRACT This research discusses how effective the implementation of master plan for domestic waste management is in regard to Article Paragraph of Government Regulation of the Regency of Gresik Number 5 of 2017 on Waste Management. In fact, the volume of domestic waste is mounting and the landfill in the Regency of Gresik is out of capacity. The volume of the waste coming from household is quite huge, and this fails to meet the balance beetwen the existing regulation, law enforcers, facilities and infrastructure, society, and the master plan. The aforementioned background serves as the groundwork of this research which is focused on the effectiveness of Article 7 Paragraph (2) letter a of Regional Regulation of the Regency of Gresik Number 5 of 2017 concerning Domestic Waste Management in regard to the master plan. Moreover, this research also digs out deeper to the impeding factors that hamper the master plan execution and the effectiveness of the article. Empirical juridical method along with socio-juridical approach was employed, in which the research took place in Waste Management of Environment Agency in the Regency of Gresik. The data involved both primary and secondary materials, where the former was obtained by conducting direct interviews with informants, while the latter was conducted by studying available relevant literature coming from legal, experts and sources from the Internet, followed by qualitative-descriptive analysis of the data. The research result reveals that the regulation has not been effectively implemented regarding the master plan of domestic waste management, as some factors coming from law enforces, facilities and infrastructure that support law enforces, society, and culture have mainly caused the ineffectiveness of the implementation.
