- Sayyidatun Nashuha Basyar Fakultas Hukum Universitas Brawijaya ABSTRAK Rekrutmen hakim konstitusi dilakukan oleh 3 (tiga) lembaga negara, yakni Mahkamah Agung, Presiden, dan Dewan Perwakilan Rakyat. Rekrutmen yang dilakukan juga memperhatikan prinsip partisipasi dan transparansi, seperti yang telah dicantumkan didalam Pasal 19 Undang-Undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi. Akan tetapi dalam pelaksanaannya rekrutmen hakim konstitusi penerapan prinsip partisipasi dan transparansi masih menjadi perdebatan. Mahkamah Agung, Dewan Perwakilan Rakyat, dan Presiden sebagai lembaga negara yang berwenang melakukan rekrutmen hakim konstitusi, dalam pelaksanaannya telah mempertimbangkan prinsip transparansi dan partisipasi. Akan tetapi dengan adanya peristiwa tertangkapnya hakim konsitusi dalam kasus pidana kemudian menjadi awal mula timbulnya pertanyaan dan pernyataan terkait perlunya perbaikan dalam sistem rekrutmen hakim konstitusi itu sendiri. Dengan menggunakan prinsip partisipasi dan transparansi serta indikator-indikator didalamnya kemudian dapat ditemukan terkait solusi serta pelaksanaan rekrutmen hakim konstitusi. Sehingga rekrutmen hakim konstitusi dapat memaksimalkan prinsip partisipasi dan transparansi. Kata kunci: Rekrutmen Hakim Konstitusi, Prinsip Partisipasi dan Transparansi. ABSTRACT The recruitment of constitutional court justice members is performed by three state bodies: Supreme Court, President, and House of Representatives, which pays attention to the principle of participation and transparency, as enacted in Article 19 of Law Number 24 of 2003 on Constitutional Court. However, in the practice, the implementation of participation and transparency principles in the recruitment of Constitutional Court justice members is still in dispute. Supreme Court, House of Representatives, and President as state bodies that are authorized to recruit the constitutional court justice members have considered the principle of participation and transparency. However, a question rises regarding whether there should be a reform in the system of recruitment due to the criminal case that involved some constitutional court justice members. When the principle of participation and transparency and indicators contained therein are determined, the solution and recruitment of constitutional court justice members can be set. It is expected that the recruitment can optimize the principle of participation and transparency.
