Karya tulis ini mengangkat rumusan masalah : (1) Apa Kendala yang dihadapi oleh Penyidik Pegawai Negeri Sipil Bea Cukai dalam Melakukan Penyidikan Tindak Pidana Peredaran Rokok Ilegal di Kantor Pengawasan dan Pelayanan Bea Cukai Tipe Pratama Probolinggo? (2) Bagaimana Upaya yang dilakukan oleh Penyidik Pegawai Negeri Sipil Bea Cukai Untuk Mengatasi Kendala Penyidikan Tindak Pidana Peredaran Rokok Ilegal di Kantor Pengawasan dan Pelayanan Bea Cukai Tipe Pratama Probolinggo ?.Penelitian ini adalah penelitian hukum yuridis empiris dengan pendekatan sosiologis. Dari hasil penelitian penulis memperoleh jawaban bahwa penyidik pegawai Negeri sipil bea cukai probolinggo mengalami kendala didalam melakukan penyidikan yaitu dari segi faktor internal dan faktor external. Kata kunci: Kendala,Penyidik pegawai Negeri sipil Bea Cukai,Rokok Ilegal. Abstract This research observed the obstacles encountered by a state investigator working for customs and excise department over enquiry of criminal case of illegal cigarettes, as the incidence of the related unsolved cases is high in number in Customs and Excise Department in Probolinggo. Several research problems are presented in this research: (1) What obstacles are faced by the state investigator of Customs and Excise Department over the enquiry of illegal cigarettes in a Small Customs and Excise office in Probolinggo? (2) What attempts are to be made by the investigator of the small Customs and Excise Department in Probolinggo to overcome the obstacles faced during the enquiry of illegal cigarettes? This research is categorised into empirical juridical research with sociological approach. The research result revealed that the state investigator of Customs and Excise Department in Probolinggo encounters some obstacles during the enquiry when seen from both the internal and external factors.
