Fakultas Hukum Universitas Brawijaya ABSTRAK Demokrasi merupakan salah satu aspek penting dalam pemerintahan dan hierarki kekuasaan yang terdapat dalam suatu sistem politik Negara. Kebijakan desentralisasi yang di maktubkan dalam konstitusi UUD NRI 1945, menciptakan sub bagian dalam praktek demokrasi lokal. Partisipasi masyarakat yang turut serta dalam proses demokrasi pada tingkat lokal, memberikan pengaruh pada pilihan calon politik yang akan duduk pada lembaga pemerintahan. Pilihan masyarakat tersebut berdampak pada legitimasi masyarakat kepada pasangan calon Kepala Daerah Dan Wakil Kepala Daerah. Pilihan yang dilakukan tersebut dapat dipengaruhi oleh faktor internal dan eksternal. Media memiliki peran yang dapat menggiring opini masyarakat terhadap calon politik dalam masa kampanye. Keterkaitan media yang banyak ditemukan dengan partai politik yang turut serta dalam proses demokrasi di Indonesia, maupun pada tingkat daerah. Konsep pengaturan media yang masih kabur dalam Undang-Undang Nomor 10 Tahun 2016 tentang Pemilihan Umum Kepala Daerah dan Wakil Kepala Daerah, belum menjawab kebutuhan masyarakat dalam memilih dan calon politik dalam praktek penyelenggaraan demokrasi. Banyak kelemahan-kelemahan dalam Undang-Undang tersebut dimulai dari sebelum kampanye, selama kampanye, hingga pasca kampanye, tidak ditemukan pengaturan media yang seharusnya bertindak dalam setiap agenda tersebut. Perbandingan dilakukan dengan Undang-Undang Nomor 42 Tahun 2008 tentang Pemilu Presiden Dan Wakil Presiden, dan Undang-Undang Nomor 8 Tahun 2012 tentang Pemilihan Umum Anggota DPR, DPD, Dan DPRD. Maka penulis melalui metode penelitian normatif berusaha memberikan analisis mengenai kelemahan-kelemahan Undang-Undang Pemilukada dalam hal pengaturan media dan berusaha memberikan konsep dalam pengaturan media untuk Pemilihan Umum Kepala Daerah Dan Wakil Kepala Daerah. ABSTRACT Democracy is an important aspect in government and the hierarchy of power embodied in a political system of the State. The decentralization policy which is enacted in the constitution of the 1945 Constitution of the Republic of Indonesia, creates a subset of local democratic practices. Participation of the people who participate in the democratic process at the local level, influences the choice of political candidates who will sit on government agencies. The choice of the community has an impact on the legitimacy of the community to the candidate pair of Regional Head and Deputy Regional Head. The choices made can be influenced by internal and external factors. The media has a role that can lead to public opinion on political candidates during the campaign period. Media linkages are commonly found with political parties participating in the democratic process in Indonesia, as well as at the regional level. The concept of media arrangement that is still obscure in Law Number 10 Year 2016 regarding General Election of Regional Head and Deputy Regional Head, has not answered the needs of the community in choosing and candidates in the practice of democracy. Many of the weaknesses in the Act began from before the campaign, during the campaign, to the post campaign, no media settings were found to be acting on any such agenda. Comparison is done by Law Number 42 Year 2008 regarding Presidential and Vice Presidential Election, and Law Number 8 Year 2012 on General Election of Members of DPR, DPD, and DPRD. Thus this study employed normative research to give analysis on the weaknesses and give concept on the media arrangement of Law on general Election for Head of region in terms of media arrangement.
