Penduduk yang ada di Indonesia hidupnya dipengaruhi oleh nilai, norma dan adat istiadat terhadap sikap dan perilaku yang menginginkan banyak anak. Pada Negara berkembang masih cenderung diterimanya banyak anak kebijakan yang ditujukan untuk dapat menurunkan fertilitas harus dapat diyakinkan bahwa demi kebaikan Negara, juga dengan kebaikan kehidupan masyarakat. Pada era reformasi seperti sekarang ini, tuntutan pemerintah agar dapat menjalankan fungsi dasar secara maksimal, menjadi sebuah tuntutan yang tidak dapat dielakkan dan harus dipenuhi. Adapun fungsi dasar pemerintah adalah pembangunan, pemberdayaan, dan fungsi pelayanan publik yang salah satunya adalah pelayanan hak identitas diri dan hak kewarganegaraan. Untuk itu pemerintah menerbitkan undang-undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan demi menjalankan perannya sebagai pelayanan publik. The theme was chosen in order to find solutions to the problems of people without birth certificate and the obstacles encountered by the Departement of Population and Civil Registration of Malang Regency. This study used empirical juridical method which was a research method conducted on the real implementation of law practice in society and to analyze the legal institution’s meaures related to the problems in order to providelegal certainty. Sociological juridical approach was conucted using two techniques which were field study and library research. There were two types of data employed in the research, whice were primary legal material obtained from the source through field study and secondary data obtained from books, legislation, library research, and internet. The result of the study show that article 53 of Malang Regional Regulation has not been effectively implemented because many citizens of Malang Regency do not have birth certificate. This study aimed at describing an analyzing the effectiveness of article 55 of Malang Regional Regulation number 2 year 2009 about population administration related with birth registration. It is then expected that citizens know the importance of birth certificate possession and the Departement of Population and Civil Registration of Malang can do iys duties and functions effectively and in accordance with the vision and mission of the Departement of Population and Civil Registration of Malang Regency.
