Fakultas Hukum Universitas Brawijaya Email : azkaauliaabdillah@gmail.com ABSTRAK Pada skripsi ini, penulis mengangkat permasalahan mengenai Efektivitas Pasal 6 Ayat (2) Peraturan Daerah Kabupaten Kotawaringin Barat Nomor 5 Tahun 2003 dimana peraturan daerah ini mengatur mengenai hal bangunan air dan juga Izin Mendirikan Bangunan Air atau IBA. Bangunan air disini dikhususkan kepada bangunan air berupa dermaga ataupun pelabuhan yang ada di Kabupaten Kotawaringin Barat tepatnya. Pilihan tema tersebut dilatar belakangi oleh semakin banyak bermunculannya bangunan air yang terdapat di Kabupaten Kotawaringin Barat tanpa memiliki IBA tersebut. Apabila bangunan air khususnya dermaga atau pelabuhan tersebut tidak memiliki izin, maka pemerintah daerah selaku yang berwenang atas hal ini tidak dapat mengawasi apa saja yang dapat terjadi dalam proses transportasi dan angkutan dalam dermaga atau pelabuhan tersebut. Hal ini tentu berdampak pula kepada penyerapan retribusi daerah yang harusnya di dapatkan dari retribusi izin bangunan air tersebut. Pelaksanaan pasal 6 ayat (2) Peraturan Daerah Kabupaten Kotawaringin Barat Nomor 5 Tahun 2003 masih belum efektif dikarenakan belum terlaksananya secara sempurna atas apa yang terkandung atau yang diperintahkan untuk ditaati dan dilakukan. Dengan adanya hambatan dari faktor tindakan pemerintah maupun faktor kondisi masyarakat membuat peraturan ini tidak efektif. Namun dari semua hal tersebut dapat diberikan solusi yaitu adanya peningkatan koordinasi antar dinas-dinas yang saling berkaitan. Kata kunci : Efektivitas, Bangunan Air, Izin. Faculty of Law, University of Brawijaya Email : azkaauliaabdillah@gmail.com ABSTRACT In this thesis, the author raised the issue regarding the effectiveness of article 6 paragraph (2) the West Kotawaringin Regency Regional Law No. 5 of 2003 where this regional law set about water building and also permits of established the water building or IBA. The water building here is devoted to water building that consist of dock or port of West Kotawaringin Regency. The reason of this theme became the choice og the author because of the emergence of growing number for water building that established without IBA. When the water building particular did not have permission, then the regional government is not able to keep an eye on what is happening in the process of transportation. It also has certainly had an impact to absorption of regional levy that got from to permit levy from water building. The effectiveness of article 6 paragraph (2) of the West Kotawaringin Regency Regional Law No. 5 of 2003 is still not yet because the implementation is not yet completely. The existence of barriers of government’s action factors as well as society condition factors makes this rule ineffective. But all of the solution is the improvement of coordination of every related departements services. Keywords : Effectiveness, Water Building, Permit.
