Fakultas Hukum Universitas Brawijaya Email : Desyratma@gmail.com Abstrak Penulisan ini mengkaji tentang Perlindungan Hukum Bagi Whistleblower dalam mengungkap tindak pidana korupsi. Whistleblower adalah pelapor dan saksi pelapor tindak pidana korupsi yang kedudukannya sebagai masyarakat dalam Lembaga Swadaya Masyarakat yaitu sebagai aktivis anti korupsi. Bentuk perlindungan hukum yang diberikan kepada whistleblower ditujukan secara preventif berupa pencegahan perkara dan represif berupa penyelesaian perkara. Tujuan penulisan ini membentuk suatu perlindungan hukum bagi whistleblower yang belum mendapatkan perlindungan hukum secara maksimal baik secara preventif dan represif, pemaknaan kekaburan terhadap pemahaman whistleblower sebagai pelapor dan saksi pelapor, dan perlindungan hukum bagi whistleblower yang diberikan oleh KPK dengan bantuan LPSK serta pemerintah/Negara. Kata kunci : whistleblower, perlindungan hukum, tindak pidana korupsi, Komisi Pemberantasan Korupsi, masyarakat, aktivis anti korupsi. Law Faculty, Brawijaya University Email : Desyratma@gmail.com ABSTRACT This study examines the legal protection for the Whistleblower in exposing corruption. Whistleblower is rapporteur and witness of corruption which serves as a Non-Governmental Organization called as a anti-corruption activist. The form legal protection given to the Whistleblower is a preventive protection which is in the form of prevention of a case and represive which is in the form of completion of the case. This study aims at making a legal protection for Whistleblower who does not get the best legal protection yet, wheteher represive or preventive protection. The present study also tries to give clearer definition on the meaning of Whistleblower as rapporteur and witness. The last purpose of the study is to give legal protection by Corruption Eradication Commission, LPSK, and Government. keywords: whistleblower, legal protection, corruption, Corruption Eradication Commission, socitey, anti-corruption activist
