Mengenai izin dalam hal ini telah diatur dalam Pasal 9 ayat (2) UUHC setiap orang yang menggunakan hak cipta harus memiliki izin, dan pada Pasal 9 ayat (3) melanjutkan lagi bahwa tanpa seizin dari para pihak yaitu Pencipta maupun Pemegang Hak Cipta tidak dapat melakukan penggunaan yang bertujuan komersial. Tujuan dalam penelitian ini adalah Untuk mengetahui perlindungan dan upaya hukum atas Hak Cipta dan Hak Terkait dalam kasus penggunaan backsound lagu pada video yang bernilai komersial. Jenis penelitian yang dilakukan oleh penulis adalah menggunakan metode penelitian Yuridis Normatif. Berdasarkan hasil dari penelitian mengenai pembahasan perlindungan maupun upaya hukum mengenai Hak Ekonomi yang diterima oleh para Pencipta dan Pemegang Hak Terkait telah terkandung dalam UU No.18 Tahun 2014 tentang Hak Cipta, WIPO Performances and Phonogram Treaty 1996, dan Beijing Treaty 2012. About permission in this case have been set up in article 9 paragraph (2) any person who uses UUHC copyright must have permissions, and in article 9 paragraph (3) continue to mention that without the permission of the parties, namely the creator or copyright holder cannot make use of the commercial aims. The goal in this research is to know the protection and remedy over the copyright and Related Rights in the case of the commercials video track on backsound. The type of research conducted by the author is using the Juridical Normative research methods. Based on the results of research regarding the discussion of protection or remedy regarding economic rights received by the creators and holders of Related Rights had been embodied in Act No. 18 by 2014 about copyright, the WIPO Performances and Phonogram label Treaty in 1996, and the Beijing Treaty.
