- Banyak terdapat tindakan diskriminasi terhadap para penyandang disabilitas. Dimana mereka semua tidak mendapatkan aksesibilitas didalam perlindungan ketika terdapat situasi beresiko dan keadaan darurat. Padahal perlindungan bagi penyandang disabilitas merupakan hak asasi manusia yang telah dijamin keberadaannya didalam UUDN RI Tahun 1945, Convention on The Rights of Persons with Disabilities (Konvensi Internasional tentang Hak-Hak Penyandang Disabilitas), Undang-Undang No. 19 Tahun 2011 tentang Ratifikasi Convention on The Rights of Persons with Disabilities (CRPD). Bentuk diskriminasi terhadap perlindungan dalam situasi beresiko dan darurat terhadap para penyandang disabilitas dilatar belakangi oleh kurang pahamnya pemerintah mengenai keberadaan serta kebutuhan perlindungan terhadap kaum disabilitas. Keresahan kaum disabilitas dalam hal mendapatkan perlindungan dalam situasi beresiko dan darurat telah diapresiasi dengan baik oleh Pemerintah. Hal ini terbukti dengan erbitnya Undang-Undang Nomor 8 Tahun 2016, khususnya dalam pasal 20 telah terinci mengenai kewajiban pemerintah dalam melindungi kaum disabilitas ketika situasi beresiko dan darurat. Secara normatif bentuk perlindungan dari pemerintah terhadap kaum disabilias ialah sebagai berikut :Mendapatkan informasi yang mudah diakses akan adanya bencana; Mendapatkan pengetahuan tentang pengurangan resiko bencana; Mendapatkan prioritas dalam proses penyelamatan dan evakuasi dalam keadaan bencana; Mendapatkan fasilitas dan sarana penyelamatan dan evakuasi yang mudah diakses; dan Mendapatkan prioritas, fasilitas, dan sarana yang mudah diakses di lokasi pengungsian. Where they do not get accessibility in protection when there is a situation at risk and emergencies. And protection of people with disabilities is a human right who have been guaranteed its existence in UUD of indonesia in 1945, Convention on The Rights of Persons with Disabilities, The act of no. 19 years 2011 about ratification Convention on The Rights of Persons with Disabilities. Forms of discrimination in protecting in a situation risky and emergency to the people with disability while such by less the government of the existence of the and needs of the protection against people with disability. Disquiet people with disability in terms of shelter in a situation risky and emergency have appreciated with by both the government. It was proven by erbitnya act no. 8 2016, Especially in article 20 have details on obligation the government in protect the with disability when the situation risky and emergency. As normative the form of protection from a government against people disabilias is as follows : Get information easily accessible about the disaster; Have an understanding of disaster risk reduction; Given priority in the process of rescue and evacuation in a state of disaster; Get facilities and rescue and evacuation easily accessible; and priority , facilities , means and easily accessible at the evacuation place.
