- Abstract The writing this journal discusses the legal issues relating to the occupation of Arable Land Kelompok Tani Anak Negerifief State Measures Relating To Improvement Of Arable Landwhich is above Land AuthorizationPT.Kalimanis Plywood Industries. The purpose of this study, to analyze perspective and the actions of the efforts made by Kelompok Tani Anak Negeri through the responses of government officers in charge of the status of arable Kelompok Tani Anak Negeri are located in subdistrict Sungai Kapih district Sambutan city Samarinda in east kalimantan province. The research methods used in this thesis is empirical legal research. The approach used is a live case study approach. The Results of discussion this journal that according to government officers in charge of the land area of 40 hectares in order to clarify the status and clarity of the land, the right base by Surat Pelepasan Hak Atas Tanah (SPHT) when examined from the theory and the legislation in force, can not be used as proof of ownership by UUPA, especially the fact that land abandoned for years, abandoned by the right holder of the land should have fallen to the country. Attempts to do Kelompok Tani Anak Negeri Affairs is to coordinate with the officials of the City Government of Samarinda related to the land BPN Samarinda as authorities issued a decree, should immediately issue a determination of the status of abandoned land, once the land is returned to the country, then Kelompok Tani Anak Negerican make application for registration of the land for the first time to the country with the underlying evidence during the tenure of this amplified statement related government personnel. Key words: occupation, farmers group, government apparatus, arable land Abstrak Penulisan jurnal ini membahas permasalahan hukum yang berkaitan dengan Pendudukan Tanah Garapan Kelompok Tani Anak Negeri Terkait Dengan Upaya Peningkatan Hak Atas Tanah Garapan yang berada diatas lahan penguasaan PT. Kalimanis Plywood Industries. Tujuan penelitian ini, untuk menganalisis perspektif dan tindakan dari upaya yang dilakukan oleh Kelompok Tani Anak Negeri melalui tanggapan aparatur pemerintahanyang berwenangterhadap status tanah garapan Kelompok Tani Anak Negeri yang berada di Kelurahan Sungai Kapih Kecamatan Sambutan Kota Samarinda Provinsi Kalimantan Timur. Metode penelitian yang digunakan dalam penulisan tesis ini yaitu penelitian hukum empiris. Pendekatan yang digunakan yaitu pendekatan live case study. Hasil pembahasan dari jurnal ini yaitu menurut aparatur pemerintahan yang berwenang terhadap lahan seluas 40 hektare agar dapat diperjelas status dan kejelasan tanahnya, alas hak berdasarkan Surat Pelepasan Hak Atas Tanah (SPHT) bila dikaji dari teori dan peraturan perundang-undangan yang berlaku, tidak dapat dijadikan bukti kepemilikan yang sah menurut UUPA, terlebih pada kenyataanya lahan tersebut diterlantarkan selama bertahun-tahun, ditelantarkan oleh pemegang haknya maka lahan tersebut seharusnya telah jatuh kepada Negara.Upaya yang dapat dilakukan Kelompok Tani Anak Negeri yaitu dengan berkoordinasi dengan aparatur Pemerintahan Kota Samarinda terkait, terhadap lahan tersebut pihak BPN Kota Samarinda sebagai pihak yang berwenang mengeluarkan ketetapan, sebaiknya segera mengeluarkan penetapan status tanah terlantar, setelah tanah tersebut kembali kepada negara, selanjutnya kelompok tani anak negeri dapat melakukan permohonan pendaftaran tanah untuk pertama kali kepada negara dengan di dasari bukti-bukti penguasaan lahan selama ini diperkuat dari peryataan aparatur pemerintahan terkait.
