- The UUD 1945 regulate and guarantee human rights and citizens' constitutional rights. Those rights provided for in Article 28 of the UUD 1945. One of the rights of citizens are have equal status in law and government.The constitutional rights occupies positions in goverenment institutions or structural position further stipulated in Law No. 43 of 1999 and Goverenment Regulation No. 100 of 2000 jo Goverenment Regulation No. 13 year 2002 regarding the appointment of Civil Servants in structural positions. Empirical data shows that male officers for 232,738 people or 80.5 per cent and women for 56,425 people or 19.5 percent. Judging from the composition of the levels of office, officials of echelon I have some 684 people or 0.24 percent, echelon I here include the Regional Secretary of the provincial local government level. In terms of gender echelon I found that women amounted to 65 people or 9.5 per cent. Echelon II there were some 11,421 people or 4 percent consisted of 10,671 men and 750 women, while the third echelon and there are 53,866 people of whom 7096 are women and echelon IV some 210,804 people and 12,388 echelon V number of people or 4.28 percent. Based on these data showed that low quantities of Women Civil Servants in structural positions. Problems that arise are whether there is a gender imbalance in the structural appointment in goverenment agencies.Appointment of Civil Servants in a structural position does not based on gender, ethnicity, race, proximity or any other forma legal but on defined terms on the legislation is Law No. 43 of 1999, Goverenment Regulation No. 100 of junto 2000 Goverenment Regulation No. 13 of 2002, and the Decision of the Head of State Civil Service Agency No. 46 A in 2003. that the appointment was based solely on competence and professionalism of the Civil Servant concerned.Keywords : Civil Service women's constitutional rights, structural position
