- Constitutional Court Decision No. 5/PUU-V/2007 which provides the opportunity for independent candidates as participants in local elections directly, it raises the pros and cons. On the one hand a great effect on the strengthening of the constitutional rightsof citizens. This is supported by several resource persons, that the recognition of independent candidates are recognizing the rights guaranteed citizens' rights relatingto equality, especially in the area of governance that could be side to be the increased protection of constitutional rights of citizens by the government. But on the other hand, need to reform both legally and politically in the face of local elections that will come, in order to create the format of a better election.Keywords: Constitutional Rights, IndependentCandidate, Equality.
