- This article aims to understand the actualization of land acquisition in the construction of the Sukoharjo East Ring Road (JLT) and the obstacles encountered in the implementation of land acquisition. This research is included in empirical legal research and is descriptive in nature which is then analyzed qualitatively. The results showed that the actualization of land acquisition for the construction of JLT Sukoharjo was not fully in accordance with Law Number 2 of 2012 because there was no deliberation to determine the amount of compensation, but only determined the form of compensation. There are several obstacles to the land acquisition process for the construction of JLT Sukoharjo, namely there are parties who do not agree on the amount of compensation, the certificate for the land is lost, the owner of the prospective land as a replacement for the village treasury land cannot show the original certificate for the land, and the processapproval from the Head of the Regional Office of the Ministry of Religion of Central Java for the exchange of waqf assets takes a long time.
- Artikel ini memiliki tujuan untuk memahami pelaksanaan pengadaan tanah dalam pembangunan Jalan Lingkar Timur (JLT) Sukoharjo beserta kendala yang ditemui di dalam pelaksanaan pengadaan tanahnya. Penelitian ini termasuk ke dalam penelitian hukum empiris dan bersifat deskriptis yang kemudian di analisis secara kualitatif. Hasil penelitian menunjukkan bahwa pelaksanaan pengadaan tanah untuk pembangunan JLT Sukoharjo belum seutuhnya sesuai UU Nomor 2 Tahun 2012 dikarenakan tidak adanya musyawarah penetapan besaran ganti rugi, melainkan hanya penetapan bentuk ganti kerugian. Terdapat beberapa kendala pada proses pengadaan tanah untuk pembangunan JLT Sukoharjo, yaitu adanya pihak yang tidak sepakat mengenai besaran ganti kerugian, sertifikat atas tanah hilang, pemilik calon tanah pengganti tanah kas desa tidak dapat menunjukkan sertifikat asli atas tanahnya, dan proses persetujuan dari Kepala Kanwil Kemenag Jawa Tengah untuk penukaran harta benda wakaf membutuhkan waktu yang lama.
