- This research was aimed to explain the implementation of compensation given for victim by criminal in the process of criminal justice system, and and to scrotinize the typical of compensation given by criminal to the victim especially in rape case. Method used this research was qualitative method by applying legal and descriptive approach. Data used in this research consist of primary and secondary data. Primary data were collected through field research, while secondary data were obtained through reviewing some literatures related to the problems highlighted above. The result of study shows that the implementation of compensation given for the victim by criminal in the process of criminal justice system can be paid on the basis of claim requested by the victim or his family prosecutor as stipulated in Article 98 Code of Criminal Procedure Law. Even through this compensation is paid for the victim, it does not make the criminal free from the punishment as provided in the Code of Criminal Procedure Law above.
