- ABSTRAK Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta merubah ketentuan mengenai perjanjian jual beli putus hak cipta, dimana perjanjian jual putus yang telah mencapai jangka waktu 25 tahun, hak cipta harus dikembalikan kepada pencipta. Tujuan dilakukannya perubahan jangka waktu terkait jual beli putus tersebut yaitu untuk melindungi hak ekonomi pencipta. Tujuan dari penulisan ini adalah untuk mendapatkan pemahaman mengenai akibat hukum suatu penerbitan dalam hal jangka waktu perjanjian jual putus telah melewati batas waktu 25 tahun, serta menganalisis dan mendapatkan pemahaman mengenai tindakan hukum yang sebaiknya dilakukan oleh penerbit terhadap pencipta dalam jual putus untuk melindungi haknya dalam hal royalti telah dibayarkan secara lumpsum berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan Kitab Undang-Undang Hukum Perdata. Metode yang digunakan adalah metode yuridis normatif, dengan cara menelaah ketentuan-ketentuan dalam peraturan perundang-undangan yang berkaitan dengan masalah dalam hak cipta. Didukung dengan bahan hukum primer yaitu wawancara langsung dengan penerbit PT Mizan Publisher, bahan hukum sekunder berupa buku-buku, atau karya ilmiah yang berhubungan dengan hak cipta dan perjanjian dan bahan hukum tersier yaitu dari interner, artikel, koran yang membahas tentang hak cipta dan perjanjian. Berdasarkan hasil penelitian yang telah dilakukan bahwa tindakan penerbitan yang telah melewati batas waktu 25 tahun merupakan sebuah pelanggaran hak ekonomi yang dimiliki oleh pencipta hal ini berdasarkan pada Pasal 9 ayat (2) dan ayat (3) UUHC. Tindakan hukum yang sebaiknya dilakukan oleh penerbit dalam jual putus untuk melindungi haknya dalam hal royalty telah dibayar secara lumpsum adalah dengan melakukan negosiasi berdasarkan Pasal 95 ayat (1) UUHC untuk membuat kesepakatan baru dengan pencipta ataupun ahli waris. The purpose of changing the time period related to the sale and purchase of the off is to protect the economic rights of the creator. The purpose of this paper is to get an understanding of the legal consequences of a publication in terms of the term of the sale agreement has passed the deadline of 25 years, and analyze and get an understanding of the legal actions that should be carried out by the publisher against the creator in selling out to protect their rights in terms of Royalties have been paid in lump sums based on Law Number 28 of 2014 concerning Copyright and the Civil Code. The method used is a normative juridical method, by examining the provisions in the legislation relating to issues in copyright. Supported by primary legal materials, namely direct interviews with PT Mizan Publisher, secondary legal materials in the form of books, or scientific works related to copyright and agreements and tertiary legal materials, namely from interners, articles, newspapers discussing copyright and agreements. Based on the results of research that has been carried out that the act of issuance that has passed the deadline of 25 years is a violation of economic rights owned by the creator, this is based on Article 9 paragraph (2) and paragraph (3) of the UUHC. Legal action that should be carried out by the issuer in selling off to protect his rights in the event that royalty has been paid in lump sums is by negotiating under Article 95 paragraph (1) of the UUHC to make a new agreement with the creator or heir.
