- Implementation of article 106 verse (8) on the obligation of wearing a Indonesian Nasional Standard helmet in the region of Malang Police are still encountered various kinds of violation, particularly violations of standart helmet. Violation of this will lead to many obstacles in implementing the regulations, both for police officer and motorists. This research took the formulation of the problem: How does the implementation of article 106 verse (8) law No. 22 of 2009 concerning the obligation to use Indonesian National Standard Helmet (SNI) in Malang Police, What constraints faced by both the Police in Malang and user of motor vehicles in the implementation of article 106 verse (8) law No. 22 of 2009 concerning the obligation to use Indonesian National Standard Halmet (SNI). This reserch used juridical Siciological approaches, data collection techniques in the form of interview with officers of traffic Division of Malang Police, documentation, observation and speading questioner. Then the reserch data were analyzed by descriptive qualitative. Sources of data in the form of primary data and secondary data. Primary data obtained from the field, while the secondary data obtained from the legislation, books, mass media, printed and others. primary data were obtained either from he Police as well as from 50 respondents Malang bikers, indicated that many violation committed by the particular violation of SNI helmet, so that hamper law enforcement. This happened for several factors: law, law enfercement, suppoting facilities, as well as community and cultural factors. In conclution, the implementation of article 106 verse (8) law No. 22 Year 2009 on the Obligation to Wear Indonesian National Standard Helmet in Malang Police has not been effective. Since the implementation got many obstacles in general. These constraint are in the form of internal factors and external factors.
