- Determination of Aviation Act No 1 Year 2009 resulting in policy changes in the airport site determination, but this has not been regulated in implementing technical regulations. The purpose of this research is to identify laws and regulations, reviewing requirements, and draft ordinances, procedures and materials in the site determination and to evaluate the Surabaya II-Mbay airport site determination. This research was conducted by collecting secondary data includes legislation, planning standards and studies determining the site of the Surabaya II- Mbay airport. Approach method used is exploratory research through the identification and analysis to understand the characteristics of the problem by finding all the information either by interviewing and studying the literature relating to the site determination. The research results showed that the concepts of ordinances and procedures to determine the site of airport developed for the initiator consists of local government in a new public airport
